The listed services are available Monday through Thursday during normal business hours and by appointment only.

  2. Appointments maybe canceled at any time due to limited police staffing.

Firearms Release Information

Firearms that come into the possession of a law enforcement entity may only be released upon eligibility verification by the California Department of Justice Bureau of Firearms. A "Certificate of Eligibility" (COE) certifies that the Department of Justice (DOJ) has checked its records and determined that the applicant/recipient is not prohibited from acquiring or possessing firearms at the time the firearms eligibility criminal background check was performed. 

If firearms were seized by a law enforcement agency, that firearm may only be released when the registered owner of the weapon obtains a COE from the DOJ. If the firearm is associated with a criminal case, that case will have to have been adjudicated or the DA's office or court may advise the law enforcement agency, in writing, that the firearm may be returned to the rightful owner. However, even if you obtain a court order for the return of a firearm, its return will still require a COE from the DOJ. 

If a firearm was obtained unrelated to a criminal case, such as a voluntary turn in, or found/recovered and no criminal case is pending, then the owner may request the return of the firearm but will still be required to provide a COE for the weapon.

HOW DO I APPLY FOR A CERTIFICATE OF ELIGIBILITY?

Beginning January of 2022, all applicants requesting a release of firearms by a law enforcement agency must electronically submit a Law Enforcement Release (LER) application for the return of a firearm(s), ammunition, and/or ammunition feeding device(s) via the California Firearms Application Reporting System (CFARS).

You may access CFARS and set up an account by the links provided on the DOJ Bureau of Firearms webpage and if you wish to have more information regarding the Law Enforcement Release process, you may wish to check out the DOJ website: Information on the Law Enforcement Release Program website. 

Once you create an account on CFARs, you will also be able to track the status of your application. There will be a list of forms on the page of which you will need to select the Law Enforcement Gun Release Application. Please note, prior to submitting, you will need to have the following immediately available:

Firearm Type; Make; Model; Serial Number; Firearm Origin (Country of origin or manufactured); Law Enforcement Agency in possession of a Firearm; Date Seized; Case Number and Agency address.

You may be able to obtain this information from the Stallion Springs Police Department Property Room. Once the application is submitted, you will need to advise the Property Room by phone or email and the confirmation number you received upon submission. That will enable the SSPD to make any necessary inquiries as to the status of your application with the DOJ with this reference number. 

WHAT HAPPENS WHEN I RECEIVE MY CERTIFICATE?

Once you are deemed eligible by the DOJ, they will mail you an eligibility letter with a gold seal. That letter authorizes the Stallions Police Department to release the firearm to you. That letter must be presented to us in order to return the firearm within 30 days from the date on the letter to retrieve your firearm. 

After you receive the letter, contact the Stallion Springs Police Department Property room and make an appointment to come in and retrieve the firearm. Bring the original Eligibility Letter and appropriate identification with you to your appointment. Staff will verify the letter, ensure proper registration, and release the firearm to you. In some cases you may need to provided a court order along with your clearance form.

Consideration on your behalf of how you intend to transport the firearm back to your home or other location should also be made, and if you have questions staff are available to assist should you need.

Finally, if the process seems a bit difficult to navigate, you may wish to seek assistance from a local Federal Firearms Licensed dealer who are generally quite familiar with the entire process described above. 

If your firearm(s) were taken into custody by the Stallion Springs Police Department, you must wait for your case to be adjudicatedbefore your firearm can be released.  If your case has been adjudicated and you are not a convicted felon, you are not a registeredsex offender and you do not have an active restraining order against you, you must do the following to begin the process of having your firearm possibly released:   

  1. Visit the California Department of Justice (DOJ) website at http://oag.ca.gov/firearms/forms and click on the link that states, “Law Enforcement Gun Release Application (BOF 119)"
  2. Read the directions carefully and fill out the BOF119 form in its entirety.
  3. Send the completed form to DOJ per their requirements.
  4. Once the DOJ has issued you a “Determination Notice” you must fill out an SSPD "Request for Return of Property" form to make an appointment with our evidence technician.  These forms are located at the SSPD front desk, or may be downloaded below.  Turn in your completed "Request for Return of Property" form to our front desk staff during normal business hours. Our evidence technician will telephone you to make an appointment.
  5. A processing fee of $20 per firearm and $5 per each additional weapon will be collected from you at the time of release by the SSPD.  You may pay the fee by money order or cash only.  Checks will not be accepted.
  6. You must bring a valid California drivers license or California identification card with you at the time of release.
  7. Your DOJ “Determination Notice" is only valid for 30 days.
  8. If you do not provide your original DOJ “Determination Notice” to the SSPD, and follow the above directions within the 30 day period, you must start the process over again with DOJ.
  9. Any firearm that has been left unclaimed shall be disposed of by the SSPD after 180 days.

Property Release Information:

If your property was taken into custody by the Stallion Springs Police Department, you must wait for your case to be adjudicated before your property can be released.  If your case has been adjudicated, and you were not convicted, you must do the following to begin the process of having your property possibly released:

  1. You must fill out an SSPD "Request for Return of Property" form to make an appointment with our evidence technician.  These forms are located at the SSPD front desk, or may be downloaded below. Turn in your completed "Request for Return of Property" form to our front desk staff during normal business hours. Our evidence technician will telephone you to make an appointment.
  2. A flat rate processing fee of $20 will be collected from you at the time of release in the form of a money order or cash.  Checks will not be accepted.
  3. You must bring a valid California drivers license or identification card with you at the time of release.
  4. Any unclaimed property will be destroyed after 365 days.

Vehicle Release Information

  1. $160 fee
  2. Vehicle can be released to the registered or legal owner only
  3. You must provide a valid California driver’s license, valid copy of current registration and proof of insurance to receive a vehicle release tag
  4. If a 30 day hold has been placed on your vehicle, your vehicle is not releasable until 30 calendar days from the day it was impounded

 Reports Release Information:

  1. $20.00 per report
  2. $25.00 if over 10 pages
  3. Reports are released on case by case bases after review
  4. Reports are only releasable to victims or witnesses
  5. Suspects and defendants can attain reports through the Kern County District Attorney’s office

If you want to request a copy of a crime report, you must appear in person at the public service window of the police department or mail your written request to the Records Section. You can only receive a crime report if you are an authorized person such as the victim, the victim’s representative, or as provided in Section 6254 of the Government Code.  You must present photo identifcation. 

Victims of Domestic Violence, Sexual Assault, Stalking, Human Trafficking, or Abuse of an Elder or Dependent Adult are entitled to one free copy of their incident reports. Additional copies can be requested at the standard rate of $20 per report.
